In a significant ruling, the Court of Appeal has determined that the mayor of Tower Hamlets acted outside his legal authority when he attempted to dismantle three low traffic neighbourhood (LTN) schemes. This decision has been met with enthusiasm from road safety advocates who have tirelessly campaigned for over three years to maintain these traffic restrictions in areas of East London, including Bethnal Green, Shoreditch, and Columbia Road.
The case was brought before the Court of Appeal after Mayor Lutfur Rahman had previously secured a favorable ruling in the High Court last December. Rahman, who campaigned on a platform that promised to eliminate the LTNs, argued that these measures were hindering working-class individuals who depended on vehicle access. His campaign manifesto explicitly stated his intention to "reopen our roads" and abolish what he termed the unsuccessful Liveable Streets initiative, which he claimed obstructed emergency services and limited access for vulnerable residents.
However, proponents of the LTNs contended that these traffic barriers actually provided critical benefits to the community. Their efforts were bolstered by endorsements from local NHS trusts and heads of five different schools. They articulated that the LTNs represented "simple and cost-effective infrastructure" designed to safeguard public spaces from the detrimental effects of vehicular traffic and driver behavior, while simultaneously encouraging and assisting those who choose, or are compelled, to walk, cycle, or use public transport. The supporters emphasized the need for such measures to protect vulnerable members of society, alleviate social isolation, and enhance overall safety and accessibility.
During the appeal hearing, the judge concluded that Rahman lacked the authority to remove the LTNs, as they were established as part of a traffic strategy that had been agreed upon with Transport for London (TfL). Ted Maxwell from Save Our Safer Streets credited TfL's involvement as crucial to the successful outcome of the appeal. He noted, "We, as a community, spearheaded this legal challenge, raising thousands of pounds for legal support, but the role of TfL was integral, and their barrister, Charlotte Kilroy KC, was impressively effective in court. The judge affirmed that Rahman exceeded his powers."
Maxwell expressed hope that this victory would inspire activists across London, stating, "We feel vindicated, and this is an incredibly emotional moment for us. We hope that this serves as a boost for those campaigning for safer streets."
London's mayor, Sadiq Khan, has consistently advocated for reducing car usage within the city, emphasizing the need for more low-traffic streets and a commitment to implementing 20 mph speed limits. A spokesperson for TfL stated, "We are very pleased with the court's ruling, as it clarifies the legal responsibilities of London boroughs in implementing and maintaining schemes funded by TfL in alignment with the mayor's transportation strategy. Infrastructure supporting walking and cycling, like low traffic neighbourhoods, is vital for enhancing street safety."
On the other hand, a representative from Tower Hamlets Council expressed disappointment at the verdict, especially given that previous court decisions had favored their position. They indicated plans to review the judgment, which holds substantial implications for London, and they will seek permission to appeal to the Supreme Court.
